Welcome to Camino. These Terms of Service and End User License Agreement ("Terms" or "EULA") constitute a legally binding contract between you ("User," "you," or "your") and[COMPANY_NAME] (operating as Camino, "we," "our," or "us"), governing your access to and use of the Camino mobile applications on iOS (Apple App Store) and Android (Google Play Store, package: camino.app), as well as our official web services (camino.app).
By downloading, installing, registering an account, or accessing Camino, you expressly agree to be bound by these Terms under the provisions of the Danish Contract Law (Aftaleloven, LBK nr 193 af 02/03/2016), the Danish Consumer Contracts Act (Forbrugeraftaleloven, LBK nr 1457 af 17/12/2013), and Schedule 1, Part B of the Apple Developer Program License Agreement.
Summary of Key Conditions:
• Camino is a fitness gamification platform that converts physical walking and cycling into virtual game coins and rewards.
• Virtual Camino Coins carry zero cash value and cannot be redeemed for legal tender.
• GPS spoofing, sensor shakers, botting, and synthetic movement fraud are strictly prohibited and result in immediate ban and coin forfeiture.
• This agreement is concluded solely between you and Camino, not with Apple Inc. or Google LLC.
1. Acknowledgment & Scope of License
- Parties: This agreement is between you and Camino only, and not with Apple Inc. ("Apple") or Google LLC ("Google"). Camino is solely responsible for the licensed application and the content thereof.
- License Grant: Subject to your compliance with these Terms, Camino grants you a personal, revocable, non-exclusive, non-transferable, non-sublicensable license to install and run the Camino application on mobile devices that you own or control, and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions or the Google Play Terms of Service.
- Restrictions: You shall not reverse engineer, decompile, disassemble, modify, or create derivative works of the application, except to the extent permitted by mandatory European software copyright law (EU Directive 2009/24/EC).
2. Maintenance & Technical Support
Camino is solely responsible for providing any maintenance, bug fixes, and support services with respect to the application, as specified in these Terms or required under applicable European consumer sales law. You acknowledge that neither Apple nor Google has any obligation whatsoever to furnish any maintenance or support services with respect to the Camino application.

3. User Accounts, Eligibility & Fair Play
- Age Requirement: You must be at least 13 years of age (or the minimum legal age to provide valid digital consent in your EU member state, e.g. 13 in Denmark under Databeskyttelsesloven § 6, stk. 2) to register an account.
- Account Security: You are solely responsible for maintaining the confidentiality of your credentials (including Google Sign-In or Apple ID credentials) and for all activities that occur under your account.
- Anti-Fraud & Fair Play Rules: Camino relies on verified physical human movement. The following activities constitute material fraud and breach of contract:
- Using GPS spoofing apps, mock location providers, or VPN tunnels to fake geographical coordinates.
- Employing mechanical phone shakers, pendulum rockers, or synthetic sensor emulators to fabricate step counts.
- Injecting falsified workout logs into Apple HealthKit, Google Health Connect, or Strava.
- Operating automated bots, automated redemption scripts, or multi-accounting schemes.
- Enforcement & Penalties: Upon detecting sensor anomalies, velocity mismatches, or fraud, Camino reserves the right to immediately invalidate fraudulent coins, reset streaks, freeze Season Pass progression, and permanently terminate the offending account without notice or compensation.
4. Virtual Coins, Season Pass & Merchant Vouchers
- Virtual Items Only: "Camino Coins," streak badges, streak freezes, and Season Pass tiers represent virtual, in-game motivation elements. They do not constitute property, electronic money (e-penge), or financial assets, have no fiat equivalent, and cannot be purchased with or converted into legal tender.
- Merchant Vouchers: Coins can be redeemed for digital partner vouchers usable at participating independent venues in Copenhagen. Vouchers are subject to merchant availability, operating hours, and reasonable redemption quotas (e.g. 7-day cooldowns between repeat redemptions at the same merchant).
- Third-Party Venues: Camino partners with independent venues to provide perks. We do not guarantee inventory availability at any specific venue and are not responsible for venue service quality, food allergies, or admission policies.
5. Digital Content & Statutory Waiver of Right of Withdrawal (Fortrydelsesret)
Statutory Consumer Disclosure under Danish Law:
Under the Danish Consumer Contracts Act (Forbrugeraftaleloven, § 18, stk. 2, nr. 13)and EU Consumer Rights Directive (2011/83/EU, Art. 16(m)), the statutory 14-day right of withdrawal (fortrydelsesret) does not apply to the supply of digital content not supplied on a tangible medium, if performance has begun with the consumer's prior express consent and acknowledgment that they thereby lose their right of withdrawal.
By claiming digital rewards, activating in-app features, or unlocking Season Pass milestones, you give your express prior consent to the immediate supply of the digital service and expressly acknowledge that your statutory 14-day right of withdrawal ceases immediately upon delivery of the virtual benefit.
6. Warranty Disclaimers & Limitation of Liability
- "As-Is" Service: To the maximum extent permitted by applicable Danish and European law, Camino is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, express or implied.
- Apple Warranty Disclaimer: In the event of any failure of the iOS application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the application to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Camino application, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be Camino's sole responsibility.
- Physical Exercise Disclaimer: Camino encourages healthy walking and cycling habits. However, Camino is not a medical diagnostic tool or personal healthcare provider. You are solely responsible for evaluating your personal physical capabilities and complying with all local traffic, pedestrian, and cycling laws. Always consult a physician before undertaking strenuous fitness regimes.
- Limitation: Nothing in these Terms shall limit or exclude Camino's liability for death or personal injury caused by intentional misconduct or gross negligence (groff uagtsomhed), or any other liability that cannot be excluded under mandatory Danish consumer protection law.
7. Product Claims & Intellectual Property Rights
- Product Claims: You acknowledge that Camino, and not Apple or Google, is responsible for addressing any claims by you or any third party relating to the application or your possession and/or use of the application, including but not limited to: (i) product liability claims; (ii) any claim that the application fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.
- Intellectual Property Infringement: In the event of any third-party claim that the application or your possession and use of that application infringes that third party's intellectual property rights, Camino, not Apple or Google, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.
8. Legal Compliance & Sanctions
You represent and warrant that: (i) you are not located in a country that is subject to a U.S. Government or European Union embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government or EU list of prohibited or restricted parties.
9. Third-Party Beneficiary (Apple Inc.)
You and Camino acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms of Service / EULA, and that, upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.
10. Termination
You may terminate this agreement at any time by permanently deleting your account through ourAccount Deletion Portal and uninstalling the mobile applications. We reserve the right to suspend or terminate your account immediately in the event of any material breach of these Terms, fraudulent sensor manipulation, or abusive conduct.
11. Governing Law & Jurisdiction
These Terms and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of the Kingdom of Denmark (Dansk ret), excluding its conflict of law rules and the United Nations Convention on Contracts for the International Sale of Goods (CISG).
Any legal action or proceeding arising out of these Terms shall be instituted exclusively in the Danish courts, with the City Court of Copenhagen (Københavns Byret) serving as the agreed court of first instance, without prejudice to any mandatory consumer protection forum rights granted to consumers under Regulation (EU) No 1215/2012.
